To date, none of the “Business Interruption” lawsuits has evolved into a watershed court decision. The courts are still sluggish, but at this point courts have dismissed more than four times as many BI lawsuits as they have allowed.¹ Carrier forms differ, and court interpretations change over time. We encourage reporting all such incidents and obtaining a formal disposition on the part of the insurance carrier.
